1. Agreement and eligibility
These Terms form a binding agreement between you and IPROMPTIAM, Inc.. By accessing or using IPROMPTIAM, you agree to them. You must be at least 18 years old and legally able to enter this agreement.
2. Accounts
Provide accurate information, protect your sign-in credentials, and promptly notify us of suspected unauthorized use. You are responsible for activity under your account. We may suspend access to protect users, the service, or the public.
3. The service
IPROMPTIAM provides a prompt library, publishing tools, community features, direct messaging, and related educational material. Features may change as the product develops. We do not guarantee that every prompt, output, integration, or community contribution will remain available.
4. Your content
You retain ownership of content you submit. You grant IPROMPTIAM, Inc. a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, display, distribute, and moderate that content solely to operate, improve, secure, and promote the service. Public submissions may be viewed, copied, adapted, and used by other users unless a specific license says otherwise.
You represent that you have the rights needed to submit your content and that it does not violate law, privacy, confidentiality, intellectual-property rights, or these Terms.
5. Acceptable use
You may not use the service for unlawful, fraudulent, harmful, deceptive, infringing, abusive, discriminatory, sexually exploitative, privacy-invasive, or security-compromising activity. Do not scrape at scale, bypass access controls, distribute malware, impersonate others, spam users, manipulate rankings, or interfere with service operation. The Community Rules are part of these Terms.
6. AI and professional use
Prompts and AI-generated outputs can be incomplete, inaccurate, biased, or unsafe. They are not professional advice. You are responsible for reviewing outputs, protecting confidential information, and deciding whether any use is lawful and appropriate. See the AI & Professional Use Disclaimer.
7. Paid services
Prices, taxes, billing interval, trial terms, and material purchase conditions are displayed before you pay. Subscriptions renew automatically until canceled. Our Billing, Cancellation & Refund Policy is incorporated into these Terms.
8. Third-party services
The service may depend on third parties, including hosting, authentication, payments, email, and AI providers. Their services and terms may apply separately. We are not responsible for third-party products or content.
9. Moderation and termination
We may review, restrict, remove, or preserve content and may warn, suspend, or terminate accounts when reasonably necessary to enforce these Terms, comply with law, address risk, or protect the community. You may stop using the service at any time.
10. Intellectual property
Except for user content, the service, brand, software, visual design, and original materials are owned by or licensed to IPROMPTIAM, Inc.. These Terms do not transfer those rights. Copyright notices are handled under our Copyright Policy.
11. Disclaimers
To the fullest extent permitted by law, the service is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted operation, particular results, or the accuracy of user or AI content.
12. Limitation of liability
To the fullest extent permitted by law, IPROMPTIAM, Inc. and its officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, data, goodwill, or opportunity. Our aggregate liability relating to the service will not exceed the greater of US $100 or the amount you paid us during the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so they apply only to the extent lawful.
13. Indemnity
You will defend, indemnify, and hold harmless IPROMPTIAM, Inc. from claims and costs arising from your content, your misuse of the service, or your violation of law or these Terms, to the extent permitted by law.
14. Governing law and venue
Delaware law governs these Terms without regard to conflict-of-law rules. Any judicial proceeding must be brought in the state courts located in Merrimack County, New Hampshire, or the United States District Court for the District of New Hampshire, and each party consents to that jurisdiction and venue. Mandatory consumer protections in your home jurisdiction remain unaffected.
15. Changes and contact
We may update these Terms. Material changes will be communicated by reasonable means and the effective date will be revised. Continued use after an update means acceptance where permitted by law.
